Welcome to Fresh@, your exclusive online supermarket for residents of the ASBL Spire community. These Terms and Conditions ("Terms") govern your access to and use of our website and services. By using Fresh@, you agree to be bound by these Terms. If you do not agree, please do not use the website or services.

1. Eligibility

Fresh@ is a gated online supermarket service provided solely to the residents of ASBL Spire, Hyderabad. By registering or placing an order, you confirm that:

  • You are a current resident of ASBL Spire;

  • You are at least 18 years of age or accessing the website under parental or legal supervision;

  • Your residency and identity can be verified through the society’s resident database.

2. Account Registration

To use our services, you must create an account with accurate and up-to-date information. You are responsible for the security of your login credentials and all activities under your account.

Fresh@ reserves the right to verify residency and suspend or terminate any account found to be fraudulent or non-compliant with the eligibility criteria.

3. Delivery Policy

  • Deliveries are strictly limited to the premises of ASBL Spire, Hyderabad.

  • Orders will be delivered to your registered flat/unit inside the society.

  • No deliveries will be made to addresses outside ASBL Spire or to non-residents.

  • Delivery timings are between 9:00 AM and 11:00 PM, and may vary on weekends or public holidays.

4. Order Acceptance & Cancellation

  • Orders placed on Fresh@ are subject to product availability and acceptance.

  • We reserve the right to cancel or limit the quantity of any order at our discretion.

  • Users may cancel or modify orders only before the cutoff time mentioned during checkout.

5. Pricing and Payment

  • Prices are listed in Indian Rupees (INR) and inclusive of applicable taxes unless specified otherwise.

  • Prices and product availability may change without prior notice.

  • Payment can be made via UPI, credit/debit cards, or digital wallets through our secure payment gateway.

  • Cash on Delivery (COD) may be offered depending on operational feasibility.

6. Returns and Refunds

  • Returns or exchanges are accepted only for items that are defective, expired, or incorrectly delivered.

  • Return requests must be raised within 24 hours of delivery via the Fresh@ website or customer support.

  • Refunds, if approved, will be processed within 5–7 business days to the original payment method or as Fresh@ wallet credit, based on the situation.

7. Product Quality and Liability

  • We strive to maintain high standards in product quality and storage.

  • However, the responsibility for manufacturing defects lies with the product manufacturer unless explicitly stated otherwise.

  • Fresh@ shall not be held liable for any damage, loss, or injury arising from the misuse of products delivered.

8. Reward Program – Fresh@ Coins

  • Customers will earn 1 Fresh@ Coin for every ₹100 spent on non-perishable items.

  • Fresh@ Coins can be tracked via your account and redeemed during future purchases, subject to terms of the reward system.

  • Fresh@ Coins are not earned on perishable goods, delivery charges, or discounted items unless otherwise specified.

9. Use Restrictions

You agree not to:

  • Use Fresh@ for any purpose other than personal household consumption;

  • Share your account or purchase access with non-residents;

  • Attempt unauthorized access, interfere with, or disrupt the website functionality.

10. Termination of Access

Fresh@ reserves the right to restrict, suspend, or terminate your access if:

  • You breach these Terms;

  • You are no longer a resident of ASBL Spire;

  • Misuse or suspicious activity is detected on your account.

11. Modification of Terms

We may update these Terms periodically. Any changes will be posted on the website and, when significant, notified via email or platform alerts. Continued use after modifications implies your acceptance.

12. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Telangana, India. Any disputes will be resolved under the jurisdiction of the courts in Hyderabad, Telangana.
